Order and Deposit
We ask for a deposit of £500 to confirm your order at the time any order is placed.
Under the UK Consumer Contracts Regulations, customers who have not visited us but order non-customised goods, have rights including cancellation of order and refund of deposit payments subject to the requirements of proper notification, within 14 days of the order being made.
For customers who have visited us, orders can be cancelled with refundable deposit up to the commencement of construction. You will receive a courtesy email before construction is about to start after which we reserve the right to refuse refund of the deposit. For guitars with customised specification, the refund of deposit will be discretional on a case by case basis. For orders placed at distance, your refund rights are greater, please read on to returns.
Unrecoverable costs such as bank transfer fees are non-refundable unless we are proven to be at considerable fault.
Any refunds will be in the currency of the contract purchase price.
You will receive an e-mailed invoice for all transactions unless you specifically request for a postal copy.
Payment
We bank with Barclays and accept bank transfers within the U.K and internationally. Non-refundable transfer fees are payable by the customer (if applicable). We also accept cheques payable to Mr. S Eden.
Full payment for the guitar, and any other associated fees, such as case, shipment and insurance, is required before taking the guitar home with you or the guitar being couriered.
Bank details for payments via transfer will be provided with the invoice.
Collection and Courier
You are welcome to inspect and trial your guitar upon collection for as long as you need and with pre-agreed arrangement of course you are welcome to visit as many times as you like to trial guitars. As a consumer you are then fully entitled to a 12 month guarantee of workmanship and component parts.
Courier options vary and we have experience with most courier providers. We recommend opting for an express service which is often not too much more costly than economy and will happily provide you with quotes. Courier and insurance costs are fully payable by the customer. For deliveries within the U.K the cost of fully insured carriage is expected to be around £30. For international deliveries please contact for pricing. You are welcome to arrange to courier the guitar yourself in which case we no longer have any responsibility for the guitar getting to you safely once it has left the premises.
Shipment fees will be added to your invoice and are payable before dispatch.
Any custom charges and importation fees involved in international shipments are fully payable by the customer. We do not wish for you to incur any unexpected fees so it is good to be aware of what these are before committing to order.
Risk and Title
Ownership of the guitar shall pass to the buyer upon receipt of payment by Stephen Eden Guitars and delivery or collection of the guitar by the buyer. No ownership of title shall pass until such payment has been received.
Returns and Guarantee
It is your statutory right to a 12 month guarantee against identifiable fault in the manufacture and component parts.
Consumers have a right to cancel the contract or notify rejection of the goods from the moment you place your order and ends 14 days from the day you receive your goods. This is subject to legitimate reason for return (as we do not encourage buy to try as you are welcome to trial at our premises) and the guitar being to standard specification.
In regards to cancellation of customized orders we will do our best to accommodate a cancellation but if the build has started on a non-standard guitar specification we reserve the right to refuse refund of the deposit. Customized goods create additional labour and difficulties with potential re-selling.
All associated costs and fees regarding a return are payable by the customer.
In the unlikely event of a return, goods must reach us in ‘as new’ condition so it is important to be careful when playing and storing your guitar when you receive it. Guitars which reach us with any damage cosmetic or structural will be at our discretion to either invoice the customer with the fees for full repair and restoration or situation dependent be considered sold and not viable for refund.
Limitation of Liability
To the maximum extent permitted by law, we exclude all liability and responsibility to you in contract, tort, or otherwise, for any loss or damage resulting directly or indirectly, from any use of the guitar purchased, or any reliance on our service or website.
If you suffer loss or damage directly as a result of our negligence or failure to comply with these Terms and Conditions, any claim by you will be limited in respect of any one incident, or series of connected incidents, to any fees paid by you.
Force Majeure
Stephen Eden Guitars shall not be held liable for any delay in or failure to perform any or part of its agreed obligations if the delay or failure is due to causes outside our reasonable control.
Covid-19
Stephen Eden Guitars will at all times comply with government guidelines regarding the Covid-19 pandemic.
Environment
When you purchase a guitar at distance, the cardboard boxes we ship with are sealed with strong but recyclable paper based tape.
We are thrilled to have partnered with tree-nation. We have made a commitment starting 2021 to plant trees for every guitar sale with the aim to make your guitar purchase completely carbon neutral wherever you are in the world, just like this website. Unless specifically requested not to, these will be planted in your name. We value your privacy and we will at no point pass on your contact details to tree nation or any other party for that matter.
Governing Law
Any dispute (contractual or non-contractual) shall be governed by the laws of England and Wales, and the parties hereby submit to the exclusive jurisdiction of the courts of England and Wales. All transactions shall be governed and interpreted in all respects as a transaction conforming to English or Welsh law. Any dispute arising from this transaction shall be referred to the courts of England or Wales.
